RESPONSIBILITY OF GHIOTTO
Ghiotto accepts no responsibility for the use the customer intends to make of the goods purchased. In the event of "defective" goods, Ghiotto will only be responsible for their replacement. Under no circumstances will Ghiotto be held responsible for the customer's loss of earnings. Ghiotto accepts no liability for disservices attributable to force majeure of any nature or kind whatsoever should it fail to execute the contract within the agreed time. Force majeure" includes, by way of example but not limited to, measures taken by the Public Authorities, strikes, whether general or otherwise, of its own employees or of the carriers it uses to fulfil orders, and any other circumstance beyond its control.
CUSTOMER OBLIGATIONS
Upon completion of the online purchase procedure, the customer is responsible for printing and storing these General Terms and Conditions of Sale. The information contained in the General Terms and Conditions of Sale must be viewed and accepted by the customer before sending the purchase order, in order to fully comply with the condition set out in Articles 3 and 4 of Legislative Decree No. 185/1999. Acceptance is made by marking the appropriate space on the site. Failing this, the order cannot be executed.
RIGHT OF WITHDRAWAL
Customers who wish to cancel the order sent, may do so by making their request directly to Ghiotto Consumer Service at the e-mail address ghiotto.official@gmail.com: the request will be accepted if the order has not yet been processed. Pursuant to article 5 of Legislative Decree no. 185/1999, if for any reason the customer is not satisfied with the purchase made, he/she has the right to withdraw from the contract stipulated and to return the products ordered, if already delivered, without any penalty and without specifying the reason. The right of withdrawal must be exercised by the customer, under penalty of forfeiture, by sending a registered letter no later than ten working days from receipt of the products. The right of withdrawal may also be exercised, within the same term, by telegram, provided that the communication is confirmed, by registered letter with advice of receipt, within 48 hours following the sending of the telegram. If the withdrawal is carried out in compliance with the above conditions, the amount paid for the products and delivery charges will be credited to the purchaser at his choice by bank transfer to an account in his name. Reimbursement will be free of charge and made as quickly as possible, and in any case within 30 days from the date on which Ghiotto will have become aware of the exercise of the right of withdrawal by the Customer. The cost of transporting the returned goods will be borne by the Customer. Returned products must be received by Ghiotto within 30 days from the date of delivery. Returned products must be returned intact, unused and in their original packaging. If unusable, the original box may be replaced with another of equivalent size and strength. The only costs charged to the customer for exercising the right of withdrawal will be the direct costs of returning the products to Ghiotto.
PRODUCT WARRANTY
Customers purchasing from Ghiotto will have the right to return the products purchased and request a replacement of the goods if they are damaged during transport or the seals are broken. This right must be exercised by the customer, under penalty of forfeiture, no later than two days from receipt of the parcel, by contacting Ghiotto directly.
CONTROVERSIES
Any dispute concerning the application, execution, interpretation and breach of the contract entered into online by the Customer with Ghiotto will be subject to Italian jurisdiction. The Court of the place of residence or domicile of the Customer, if located in the Italian territory, shall have jurisdiction over any dispute between the parties. Should the Customer's domicile or residence be within Italian territory, the competent Court shall be that of execution of the contract.
APPLICABLE LAW AND REFERENCE
Contracts entered into online by the Customer with Ghiotto will be governed by Italian law.
For anything not expressly provided for herein, the rules of law applicable to relations and cases provided for in the contract concluded online by the Customer with Ghiotto will apply.
Pursuant to articles 1341 and 1342 of the Italian Civil Code, the Customer declares to have carefully read and expressly accepted these General Terms of Sale.
